Strengthening Credit Information Management and Regulating Construction Market Order


In order to accelerate the construction of the credit system of the construction market, standardize the order of the construction market, and create a market environment of fair competition, integrity and law-abiding, the Ministry of Housing and Urban-Rural Development recently issued the Interim Measures for the Credit Management of the Construction Market (hereinafter referred to as the Interim Measures), requiring local housing and urban-rural construction departments at all levels to adopt the provincial construction market supervision integration work platform, to identify, collect, review, update and disclose the credit information of all parties in the construction market within the administrative area. The relevant person in charge of the Construction Market Supervision Department of the Ministry interpreted the relevant contents of the Interim Measures.

According to the person in charge, for a long time, the field of housing and urban-rural construction has actively explored and promoted the construction of the integrity system of the construction market, and has achieved certain results, but there are still some outstanding problems, such as insufficient disclosure and sharing of credit information of market entities, prominent information island problems, and credit Evaluation behavior is not standardized, and individual regions set up local barriers through credit management. In order to solve these outstanding problems, the Ministry of Housing and Urban-Rural Development initiated the drafting of the Interim Measures, held several document drafting seminars, and invited some provinces and cities to be responsible for the construction of the integrity system and industry experts to put forward work on the credit management of the construction market. Suggest, and solicit opinions from the whole country many times.

The Interim Measures consists of 7 chapters and 30 articles, with six highlights.

  ■ Highlight 1: Credit Information Disclosure

Bad credit information disclosure for 6 months to 3 years

In order to solve the problems of untimely and incomplete disclosure of credit information of market entities, the Interim Measures clearly define the definition of credit information, that is, credit information includes basic information, good credit information and bad credit information; strengthen the management of credit information collection, and require Relying on the construction market supervision public service platform to collect credit information centrally, clarify the responsibility of information collection, especially requiring strengthening the verification of project information; it is stipulated that credit information should be disclosed centrally through the public service platform, and the disclosure period is specified, that is, basic information should be disclosed for a long time, good credit information should be disclosed for 3 years, and bad credit information should be disclosed for 6 months to 3 years.

In order to further improve the credit records of market entities, establish a credit information collection and sharing mechanism, and give full play to the role of the national construction market supervision public service platform, the Interim Measures require the provincial housing and urban-rural construction authorities to push the good and bad credit information of market entities To the national construction market supervision public service platform.   ■ Highlight 3: Classified supervision of enterprises

The Interim Measures require housing and urban-rural construction departments at all levels to make full use of the national construction market supervision public service platform, establish trustworthy incentives and untrustworthy punishment mechanisms, implement classified supervision of enterprises, implement incentive measures for good credit, and deal with serious untrustworthy behaviors. Take disciplinary measures in accordance with the law. At the same time, it is stipulated that relevant units or individuals should use credit information in accordance with the law, and must not use information that exceeds the disclosure period. In addition, local housing and urban-rural construction authorities at all levels should also establish a credit information objection complaint and report handling mechanism, and promptly make credit information changes through the construction market supervision public service platform.

  ■ Highlight four: the establishment of a "blacklist" system

The "Interim Measures" require the establishment of a "blacklist" system for construction market entities, and clarify the standards and conditions for inclusion in the "blacklist" of construction market entities, which are disclosed to the public through the construction market supervision public service platform. The management period of the "blacklist" of the main body of the construction market is 1 year, and the list can be removed at the end of the term. For those who are included in the "blacklist" of the main body of the construction market, disciplinary measures should be taken, restrictions should be imposed in accordance with the law in terms of market access, qualification management, bidding and bidding, and other departments should be notified to implement joint punishment.

  ■ Highlight 5: Standardizing credit evaluation behavior

No local credit barriers

At present, most places have carried out credit evaluation, but some evaluation behavior is not standardized, and even through credit evaluation to implement local protection. In order to solve these problems, the "Interim Measures" specifically provide for credit evaluation: First, clarify the subject of credit evaluation, that is, the housing and urban construction department can carry out credit evaluation in the construction market, and encourage third-party institutions to carry out credit evaluation. The second is to stipulate the main content of credit evaluation and the application scope of evaluation results, and require the credit evaluation methods, standards and results to be made public on the provincial construction market supervision integration work platform and accept social supervision. Third, in accordance with the principles of openness, fairness and impartiality, credit evaluation standards shall be formulated, non-local enterprises or individuals shall not be discriminated against, credit barriers shall not be set up, and construction units shall be encouraged to evaluate the performance of contractors.

  ■ Highlight 6: Increase supervision and inspection

The "Interim Measures" require the provincial housing and urban-rural construction departments to designate special personnel or entrust special agencies to be responsible for the collection, release and push of credit information.
